Premise Liability - Tort Law Overview

A tort, involves a breach of a civil duty owed to someone else. Parties who are injured as a result of the negligence of others may bring a tort lawsuit against the "liable" party recovered monetary damages. This is otherwise known as civil litigation.

Tort law defines what a legal injury is, and whether the injuring party can be held liable for the injuries suffered by the victim. These injuries include many things like property damage, physical injuries, pain, and suffering, mental anguish, economic loss, loss of reputation, etc. Premises liability is one of the many types of cases that are considered civil litigation or tort cases. Others include auto accidents, defective products, defamation of character, copyright infringement, pollution, etc.

In tort law, the injured party must prove the injury was caused by the defendant, and that they acted negligently - meaning without due care. Injured parties may also recover damages when the defendant acted intentionally - also known as "strict liability."

What is Premise Liability?

In premise liability cases, the defendant must be the owner or be otherwise responsible for the property. The plaintiff typically (but not in all cases) has to have been invited on to the property via an invitation, lease, or offer to do business (like a mall). Finally, there must be some act of negligence or otherwise wrongful act - as an assault.

Examples of Premises Liability Include:

  • Inadequate Security - lack of security or lighting in areas known for crime or vandalism such as parking garages or bars.
  • Slip and Fall - examples include failure to maintain walkways, snow and ice falls, or clean up spills.
  • Inadequate Maintenance and Defective Conditions - examples include deck collapses, e-coli infections from under-maintained public pools, broken stairways, building code violations, electric shocks from poorly maintained products in a premise.
