Uninsured/underinsured motorist coverage is a type of auto insurance policy that protects you in the event that you are injured in an accident with a driver who is uninsured or underinsured. Georgia law regarding insurance coverage minimums does not require drivers to carry uninsured driver insurance, but insurance companies are required to offer it.

Select 'Stacking' Car Insurance Coverage

If you can, make sure your car insurance policies are "stacking." Stacking insurance coverage means that you can add up the coverage limits of different insurance policies to recover the maximum possible compensation. Here are illustrations of non-stacking and stacking insurance coverage:

  • Non-stacking coverage: Your use of uninsured motorist (UIM) coverage is limited to the difference between the policy limits of your UIM coverage and the policy limits of the at-fault driver's liability coverage. Say that the value of your personal injury case is $75,000. The at-fault driver’s has liability coverage limits of $25,000 for bodily injury. You have uninsured motorist bodily injury coverage for $50,000. The total amount you can recover is $50,000 — $25,000 from the at-fault driver and $25,000 ($50,000 UIM coverage minus $25,000 paid from the at-fault driver's insurance).
  • Stacking car insurance coverage: You can add UIM insurance to other sources of insurance compensation. Again, say that the value of your personal injury claim is $75,000. The at-fault driver’s liability coverage maximum is $25,000 for bodily injury. You have UIM coverage for $50,000. The total amount you can recover would be $75,000 — $25,000 from the at-fault driver and $50,000 from your UIM coverage.
